Remote Gauge Portal SMS/MMS/E-Mail Messaging Terms and Conditions
for Contract Holders and their Agents and Employees
In addition to our intuitive data displays available through any Internet-connected Web browser, multiple event notification methods are provided at no extra charge. Accordingly, these Terms and Conditions supplement those specified in any contract offering from Remote Gauge LLC.
A) General. Remote Gauge LLC ("Provider") will permit each contract holder ("Customer") to access Provider's information systems (“Portal”) for the purposes of accessing information ("Data") generated by Provider's hardware products ("Equipment"). Both the Equipment and the Portal are offered as-is without liability or guarantees as to accuracy, usability, availability, or suitablility for any purpose. Provider accepts no liability for use or disuse of the Portal by Customer or its Users. Customer and Users will not cause or allow any attempt to copy, analyze, de-compile, reverse-engineer, modify, expose to any AI/SI system or agent, or otherwise examine the design or functionality of the Equipment or the Portal. If at any time Customer or a User is not in compliance with these terms or the terms of any contract for Equipment, including payment of fees, then Provider may suspend or terminate Customer’s access to and use of the Portal along with that of its Users without notice.
B) Ownership of Data. Customer owns all Data received from the Equipment. Provider will, upon Customer request and Provider approval, make available one or more application programming interfaces (“APIs”) in the Portal for remote exchange of Data. Provider may use any and all Data for any purpose related to the operation of the Portal including testing and product demonstration. Provider will exercise due diligence in protecting the Data and, with respect to Provider, Customer waives any right regarding confidentiality, condition, or custody of any and all Data. Due to reliance on third-party services outside of its control, Provider shall not be held liable for timeliness or delivery failure of any Data generated by the Equipment.
C) Agent and Employee Accounts. The Portal enables each Customer to grant access to certain portions of the Portal by Customer’s agents or employees (“Users") who have a need for such access in the ordinary course of Customer’s business. These Users are subject to these Terms and Conditions and those found in Remote Gauge LLC contracts. No additional contract or relationship is created between Provider and Users that are granted access to the Portal. Customer is responsible for accuracy of all information entered during account creation. It is the responsibility of Customer to advise each User as to the particulars of all Terms and Conditions and to instruct Users in the operation of the Portal. Provider accepts no liability for use or disuse of the Portal by any User.
D) Automated Notifications. Users have the option to enable e-mail, SMS text messages, and MMS multimedia messages for status notifications reported by the Equipment ("Alerts"). A working e-mail address and/or SMS-capable telephone number and/or MMS-capable telephone number is required to receive Alerts from the Portal. User is responsible for accuracy of all information contained in their account. A testing facility is provided to ensure that chosen notification methods work as expected. Provider is not responsible for any incorrect e-mail address or telephone number. Due to reliance on third-party services outside of its control, Provider shall not be held liable for timeliness or non-delivery of any Alert.
OPT-IN: Users have the ability to enable, select, and disable Alerts via the User Account and Alerts screens in the Portal. Users can specify which Alerts are desired and thereby be able to estimate the volume and frequency of those Alerts. By enabling e-mail or SMS text messaging or MMS multimedia messaging, each User implicitly and explicitly requests that Provider generate such messages and agrees to receive these messages from Provider. Provider is not responsible for any third-party charges for Web access, e-mail services, SMS messaging, or MMS messaging. Per message and data rates may apply.
Entering an e-mail address into the E-mail Address field on the User Account Settings screen in the Portal enables e-mail messages. Selecting one or more monitored assets for Alert notifications will cause e-mail messages to be sent at each interval specified by the Alerts selected. The number of messages sent in any given period will be the aggregate of the types and event frequency of selected Alerts. Users may incur additional charges from their communications provider for these messages. Per message and data rates may apply.
Entering an SMS-capable phone number into the Mobile Phone field on the User Account Settings screen in the Portal enables SMS text messages. Selecting one or more monitored assets for Alert notifications will cause SMS text messages to be sent at each interval specified by the Alerts selected. The number of messages sent in any given period will be the aggregate of the types and event frequency of selected Alerts. Users may incur additional charges from their communications provider for these messages. Per message and data rates may apply.
Entering an MMS-capable phone number into the MMS Phone field on the User Account Settings screen in the Portal enables MMS multimedia messages. Selecting one or more monitored assets for Alert notifications will cause MMS multimedia messages to be sent at each interval specified by the Alerts selected. The number of messages sent in any given period will be the aggregate of the types and event frequency of selected Alerts. Users may incur additional charges from their communications provider for these messages. Per message and data rates may apply.
SMS text messages and MMS multimedia messages may be sent from one or more Texas phone numbers. Users should add these numbers to a suitable contact record in their phone for easy recognition.
OPT-OUT: Users should always consult Customer in advance of changing or disabling any aspect of their Alert messaging configuration to ensure uninterrupted notifications for critical assets. Users can opt-out of receiving some or all e-mail, SMS text messages, and/or MMS multimedia messages via the User Account and Alerts screens in the Portal or by consulting Customer. While disabling a service through the Portal is the best and most immediate method of cancelling our Automated Notifications, Users may also reply to any Alert with the word “STOP” to have Provider disable all messaging for that delivery method. Alternatively, users may also relpy "HELP" or "SUPPORT" to any Alert or contact Provider directly at Support @ RemoteGauge.com or 210-607-1913. Any changes requested directly from Provider will be honored at Provider's earliest reasonable opportunity, usually within 24 hours.
WARNING: Be mindful that Automated Notifications can produce dozens of messages daily depending on the number of assets monitored and changing conditions of each asset. This a complimentary service and as such, Provider is not responsible for any cost or charges imposed by any third party to process these messages for Users regardless of chosen delivery method. To avoid surprise billings, carefully review any agreements with cellular or other communications providers involved in delivery of these messages. If you plan to travel outside of your cellular coverage area or visit another country, Users should suspend Automated Notifications while away to avoid roaming charges for messaging and data. Also check any applicable user settings available from each provider to help ensure that you will receive Alert messages as expected.
E) Customers and Users assume all liability incurred from use of the Portal and any of its features and will hold harmless Remote Gauge LLC, its officers, directors, employees, contractors, vendors, associated companies, customers, and all other related entities. User will also proactively defend these same entities from any and all claims, torts, suits, arbitration, or any other adverse action arising from utilizing any of Provider's services.
F) Data Retention. Provider stores indefinitely all data that was acquired on behalf of current and former Customers for regulatory compliance and product improvement purposes. Personally identifying information found in the User's account may also be retained. Provider's Privacy Policy pertains equally to both current and historical data held by Provider.
These Terms and Conditions may be modified at any time without notice.
